Time Warner won a UDRP yesterday for several domains related to some popular properties that it owns.

Specifically, the arbitration panel awarded transfer of the following domains:

truebloodwatchfree.info;
truebloodseason4.org;
www-cnn.com;
newscnn.com;
ben10games.com;
tbskids.org;
legobatman.com;
batman-slotmachine.com; and
gameofthrones.com. 

The panel found that even though the registrant for each domain used different aliases in the WHOIS information, that the registrant was in fact the same person – something the respondent did not challenge. Further, the panel held that even though two of the Time Warner trademarks (BEN 10 and TBS) were registered after the domains were created/registered, that the fame of the marks and earlier common law rights provided a sound basis for establishing Time Warner’s rights.

I was particularly surprised that Time Warner did not own the domain gameofthrones.com, or that the domain was not owned by the series writer George R. Martin (or his publisher) who started publishing his Game of Thrones books in 1996...
